At Sampark Foundation, we respect the privacy of the users of our website. This Privacy Policy is intended to lay down the practices we follow for honouring the privacy preferences of the people visiting our website www.samparkfoundation.org . The Privacy Policy also elaborates on our information collection and sharing practices. Irrespective of the mode in which we receive your information (whether via this website or over the phone or through any other means), we make all earnest attempts to honour your privacy. This document contains the requisite information about Sampark Foundation’s responsibilities, your rights, information which is collected by us and how it is used.

For the purposes of this Privacy Policy, references to “you” or “your” shall mean and include any individual who accesses or uses this Website to make donations or financial contributions through this Website in connection with the services provided by Sampark Foundation.

This Privacy Policy governs the use of the website https://www.samparkfoundation.org/ (“Website”). Your access to and use of this Website is conditional upon your acceptance of this Privacy Policy.

Sampark Foundation also has other applications, which are governed by their own (i) the Terms of Use available at http://samparksmartshala.org/terms, and (ii) the separate Privacy Policy applicable to the Sampark SmartShala mobile application (“Sampark SmartShala App” or the “app”). Your use of the Sampark SmartShala App shall be governed by the Terms of Use and separate Privacy Policy as applicable. 

  1. DEFINITIONS- For these Terms, the expressions below shall have the meanings given herein, shall apply.
    1. “Applicable Data Protection Laws” means the Digital Personal Data Protection Act, 2023, as and when it comes into effect, together with the Information Technology Act, 2000 and the rules framed thereunder, and as each may be amended, replaced, or superseded from time to time, including any laws or rules implementing, replacing, or supplementing the foregoing.
    2. “Information” shall mean and include all data, particulars and details as specifically enumerated under Clause 3 of this Policy.
    3. “Financial Information” shall mean the information as defined in Clause 3(ii)(c) of this Policy
    4. "Sampark", "we", "us", or "our" refers to the Sampark Foundation
    5. “Services” shall mean the services offered through this Website, including processing donations, issuing receipts and tax exemption certificates, providing updates on our work for children, responding to queries, and informing you of opportunities to support deprived and marginalized children in a holistic manner.
    6. “You,” “Your,” “Donor” or “Donors” mean current or prospective donors that can be individuals, families, corporations, or institutions who support Sampark Foundation’s mission through contributions or partnerships to transform children’s education in India.
  2. BY ACCESSING AND/OR USING THIS WEBSITE, YOU agree to abide by the practices described in this Privacy  Policy,which may be changed from time to time.
  3. INFORMATION WE COLLECT FROM YOU:
    We collect information from you to provide and improve the services  offered by Sampark and this website, including processing of your donations, providing receipts and tax exemption certificates, sending regular updates about the work we do for children, responding to your queries and apprising you of the new opportunities to help deprived and marginalized children of India in a better and holistic way.
    1. Sampark collects and processes the following categories of information from you to enable lawful receipt and acknowledgment of donations:
      1. Contact Details: such as your name, email address, phone number, residential address, City, State, and Pincode, Postal address, the name of your organisation (if applicable).
      2. Identity Information – such as name, PAN/TIN Number, and copy of the same. 
      3. Financial Information: such as credit/debit card details, bank account details, and billing information. Please note that such financial information is collected and processed exclusively by authorized third-party payment service providers on our behalf, solely for the purpose of receiving donations. 
      4. Citizenship Information – declaration of Indian or Foreign citizenship.
    2. The financial information as enumerated above such as credit card details, bank information is strictly collected and processed solely for the purpose of receiving donations and is collected by a third party payment service providers.
    3. We will retain your information including personal information in case of individuals only for as long as is necessary to fulfil the purposes for which it was collected, or as required under applicable law. Appropriate technical and organizational safeguards are applied to protect your data against unauthorised access, disclosure, alteration, or destruction as enumerated in the subsequent clauses
  4. WHERE AND WHEN WE COLLECT INFORMATION:
    We seek your information when you make a donation, request a communication from us, register for an on-ground event, pledge support to our work and campaigns and apply for working or volunteering with Sampark Foundation. This information may be sought over the phone, through the website, via email or by the means of face-to-face interaction.
    We collect and process such information only with your consent or as otherwise permitted under applicable laws, including the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 (together with the rules framed thereunder). You may choose not to provide certain information however, this may limit your ability to access specific services or participate in certain activities.
  5. PURPOSES OF COLLECTING YOUR INFORMATION
    1. Sampark collects and processes your information only for lawful, specific, and explicitly stated purposes, in compliance with Applicable Data Protection Laws and the Reserve Bank of India’s guidelines on payment security and data localization, the Foreign Contribution Regulation Act, 2010 (where applicable to foreign donations), and other applicable tax, accounting, and related laws
    2. The legitimate uses and purposes of processing your information herein may include:
      1. To issue tax exemption receipts and certificates under the Income Tax Act, 1961, which require collection of PAN/TIN details
      2. To share updates on our work, campaigns, and impact reports, and where you have provided explicit consent to send marketing or promotional communications.
      3. To respond to queries, requests for information, or opportunities for volunteering and collaboration.
      4. To analyze donation trends and patterns, using anonymized or aggregated data, in order to improve our operational efficiency and enhance the user experience on our Website.
      5. To verify donor identity (such as PAN for Indian donors) and citizenship status (for compliance with the Foreign Contribution Regulation Act, 2010 in case of foreign donations).
      6. To retain donation and transaction records for the duration required under applicable tax, accounting, or regulatory laws.
      7. To securely process donations through authorized third-party payment gateways, in compliance with Reserve Bank of India guidelines.
      8. To maintain complete and accurate audit trails.
    3. Financial Information such as credit card or bank details is processed solely by RBI-authorized payment gateways (see Clause 9). And foreign donors may be subject to additional FCRA disclosure requirements, including restrictions on the permitted use of funds.
  6. CONSENT
    1. By using our Services, including but not limited to making donations, subscribing to updates, or interacting with Sampark Foundation, you expressly consent to the collection, processing, storage, and sharing of your information in accordance with this Privacy Policy and Applicable Data Protection Laws.
    2. By providing your contact details and identity information under clause 3(i) &3(ii), you consent to its collection, storage, and processing by Sampark Foundation for the purposes of donation processing, tax compliance, communication, and other lawful activities as described in this Privacy Policy, in accordance with Applicable Data Protection Laws. You acknowledge that this information is necessary for the provision of our Services and that refusal may limit your ability to avail certain features.
    3. You expressly consent to the collection and processing of your Financial Information (credit/debit card details, bank account information) by authorized third-party payment gateways, strictly for donation processing, in compliance with RBI’s guidelines and tokenization norms. You understand that Sampark Foundation does not store sensitive payment data and that such information is handled under the privacy policies of the respective payment processors, over which we exercise no direct control.
    4. You agree that Sampark Foundation may share your information with trusted third-party service providers as explained under clause 9 solely for operational, legal, or service-related purposes. Where such parties are located outside India, you acknowledge that cross-border data transfers may occur, and Sampark Foundation will ensure contractual safeguards are in place to protect your data as per applicable laws.
    5. You consent to the retention of your information for as long as necessary to fulfill the purposes outlined in this Policy or as required by law. You understand that even after withdrawal of consent or deletion requests, certain data may be retained strictly to comply with statutory obligations and will not be utilized or retained for any other purpose.
    6. You agree to the use of cookies and similar technologies on our website to enhance functionality, analyze usage patterns, and personalize your experience. While you may disable cookies via browser settings, you acknowledge that certain features of the website may become unavailable.
    7. Your use of our Services constitutes ongoing acceptance of these consents. You retain the right to withdraw consent (where applicable) as provided under clause 10 or exercise rights (access, correction, deletion) by contacting us as provided under clause 10. However, such withdrawal may not apply to processing already carried out or where retention is mandated by law.
    8. You acknowledge and consent that in the event of a data breach affecting your rights, Sampark Foundation will notify you via email, website notice, or pop-up disclaimer, either one or all of these, as required or mandated under the Digital Personal Data Protection Act, 2023, and you agree to take reasonable steps to secure your account credentials.
    9. You agree that Sampark Foundation shall not be liable for any loss or damage arising from your failure to protect login credentials, unforeseen cyber incidents beyond our control, or force majeure events, as detailed in this Policy.
  7. INFORMATION SECURITY:
    1. Sampark Foundation has in place the necessary security mechanisms and only designated employees and authorised third party service providers, in a manner as provided in clause 9, have access to your information. Some of the security measures implemented by Sampark are enumerated below: All third party service providers having  access to your information,  are subject to confidentiality obligations and role based access controls including
      1. All online transactions are done on a secure server.
      2. All data transmissions occur via SSL/TLS encryption evidenced by the 'https' protocol and padlock icon in your browser), 
      3. Payment Processing Pages or Donation Pages adhere to relevant standards verified by VeriSign and transactions are processed using a VeriSign merchant account.
    2. Sampark Foundation takes reasonable measures to protect your data however, no system can guarantee absolute security. In the unlikely event of a breach affecting your rights, we will inform you through appropriate means such as email, website notice, or pop-up disclaimer, either by one or all of these methods, as required under the Digital Personal Data Protection Act, 2023. You are advised to keep your credentials secure and promptly report any unauthorized access to baithak@samparkfoundation.org 
    3. Sampark Foundation shall not be liable for any loss or damage arising from your failure to protect login credentials, unforeseen cyberattacks or third-party vulnerabilities beyond our reasonable security measures, or acts of government authorities and other force majeure events.
  8. DND POLICY:
    I agree and consent to receive all communications at the mobile number provided, even if this mobile number is registered under DND/NCPR list under TRAI regulations. And for that purpose, I further authorise - Sampark Foundation to share/disclose the information to any third-party service provider or any affiliates, group companies, their authorised agents or third party service providers.
    Sampark Foundation or their third-party service providers or any affiliates will be making calls and sending SMS/Email through a third-party platform.
    Provided, you retain the right to withdraw your consent to receive such communications at any time by contacting us through the details provided in this Privacy Policy.
  9. SAMPARK FOUNDATION MAY SHARE YOUR INFORMATION:
    1. Except in the limited circumstances elicited in this clause, Sampark Foundation will never intentionally share your information collected in a manner as provided in this Policy with any third party without your consent. It is clarified that some of these purposes may require your information to be stored permanently, such as to facilitate analysis of usage. The  primary data controller in respect of your information is Sampark Foundation. However, Your Information may be stored/retained by AWS (Amazon Web Services) under strict confidentiality arrangements
    2. Credit/Debit Card Transactions, Electronic Fund Transfers and Payments by Cheque:  Sampark Foundation avails the services of RBI Authorized third parties service providers (payment gateways etc. ) to provide donation facilities by means of credit/debit card payments or electronic fund transfers. While your information may be shared with these third parties, we make stringent efforts to require all third-party service- providers to hold information in strict confidence. However, since we do not have complete control over these activities, we cannot be held liable for any breach on the part of such third parties.   If Sampark Foundation is convinced that there has been some inappropriate activity with or on our website/webpages, communications, charitable services or personal or real property or if we have reasons to believe that any using one of the Sampark Foundation website, our donors, employees, partners, vendors, etc. have been inflicted with any harm, we will appropriately notify you as per law.
    3. If any government or legal bodies require any information from us under the purview of a law or a legal compliance, we may go ahead and disclose the same limited to what is strictly necessary under the legal requirement and will follow due processWhere possible, we will notify you of such disclosures unless prohibited by law.
    4. Merger, Acquisition or other Corporate Restructure: We also may transfer your information to a third-party successor in interest if we are involved in an acquisition, merger or other transfer of control or sale of assets. This transfer will under all circumstances shall ensure equivalent protection standards are maintained by the successor. You will be notified of such transfers through our website or direct communication where feasible. 
    5. Requesting Communication: We have on board certain vendors who execute several donor (existing or potential)-related activities for us like send direct mails, emailers, greeting cards, making phone calls, and others. We may share your information like phone numbers, email address, etc. with these agencies so that they can perform these activities on behalf of Sampark Foundation.These vendors are contractually bound to: (a) process data only for specified purposes, (b) implement equivalent security measures, and (c) delete data when no longer required. You may opt-out of such communications at any time.
  10. YOUR RIGHTS
    You have the following rights regarding your information under the Digital Personal Data Protection Act, 2023 and other applicable privacy laws:
    1. You may request confirmation about whether we are processing your information and obtain access to such data in our possession. This includes the right to review, correct, complete, or update inaccurate or incomplete information.
    2. You may withdraw your consent for future processing of your information at any time, provided such withdrawal does not affect the lawfulness of processing based on consent before its withdrawal.
    3. Where applicable, you may request your personal data in a structured commonly used, and machine-readable format, and have the right to transmit this data to another entity where technically feasible.
    4. In accordance with Section 12 of the DPDPA 2023, you may nominate a legal representative to exercise these rights on your behalf in case of death or incapacity.
    5. You may request deletion of your information, except where we are required to retain such information to comply with legal obligations, resolve disputes, or enforce our agreements.
    Withdrawal of consent and/or request for deletion of account and/or any request to exercise your right enumerated in this clause shall not be treated as effective unless the communication is made to the email id given below.

We will acknowledge your request within 24 hours and make reasonable efforts to resolve it within 15 days, though complex requests may require additional time. We may need to verify your identity before processing certain requests. Please note that some rights may be subject to limitations under applicable laws, particularly where processing is necessary for compliance with legal obligations or the establishment, exercise, or defense of legal claims.
  11. COOKIE POLICY:
    Cookies are pieces of electronic information which will be sent by Sampark Foundation when you log onto our website. These will be placed in your computer’s hard disk and enable us to recognise you as a user when you next visit.
    You can configure your browser so that it responds to cookies the way you deem fit. For example, you may want to accept all cookies, reject them all or get notified when a cookie is sent. Please check your browser’s settings to modify cookie behaviour as per your individual behaviour.
    Please note that if you disable the use of cookies on your web browser or remove or reject specific cookies from our website or linked sites then you may not be able to use the website as it is intended.
  12. CHANGES TO PRIVACY PRACTICES:
    We retain the right to amend this Privacy Policy from time to time. We will undertake efforts to generally notify all users of any material changes to this Privacy Policy, such as through a pop-up message (for example, disclaimer message) and/or other appropriate means, as required under Applicable Data Protection Laws. However, it is advisable  as a user of Sampark Website and/or the Services, you should look at this Privacy Policy regularly to check for such changes. We will also update the "Last Updated" date at the top of this Privacy Policy, which reflects the effective date of this Privacy Policy. Your continued access or use of Sampark Website and/or the Services after the date of the new Privacy Policy constitutes your acceptance of the new Privacy Policy. If you do not agree to the new Privacy Policy, you must stop accessing and/or using Sampark Website and/or the Services. You hereby acknowledge that any collection, storage, processing or other use of Your Information shall be governed by the Privacy Policy as applicable at the time of such collection, storage, processing or other use.
