Use of the website located at https://www.samparkfoundation.org/ (the “website/site”) and all associated services, features, and content (collectively, the “Services”) provided by Sampark Foundation on this site is subject to your acceptance of and compliance with the following Terms and Conditions as given below.

1. DEFINITIONS
   For the purpose of these Terms and Conditions, the following definitions shall apply.
    
   1. “Sampark Foundation”, “Sampark”, “we”, “us”, or “our” refers to Sampark Foundation.
   2. “Services” shall mean the services provided through this Website, including processing donations, issuing receipts and tax exemption certificates, providing updates on our work for children, responding to queries, and informing you of opportunities to support deprived and marginalized children in a holistic manner.
   3. “You”, “Your”, “User”, or “Users” refers to any person or entity who accesses, browses, or uses this Website, including but not limited to current or prospective donors, individuals, families, corporations, or institutions, who engage with Sampark Foundation’s Services or support its mission to transform children’s education in India.
   4. “Website”, “This Website”, “Site” or “This Site” refer to https://www.samparkfoundation.org/ and all related web pages, content, features, and functionalities provided directly by Sampark Foundation. It does not include any third-party websites, content, links, or services that may be accessible through the Site.


2. ACCESS TO THIS SITE & CONSENT
   By accessing, browsing, or using this Website in any manner, you acknowledge that you have read, understood, and unconditionally agree to be legally bound by these Terms and Conditions, the Privacy Policy available at https://www.samparkfoundation.org/privacy-policy.html and the Refund Policy available at https://www.samparkfoundation.org/refund-policy.html. Your use of and access to the Website constitutes your express agreement to these Terms, the Privacy Policy, and the Refund Policy, as applicable, as of the date of your first use of the Website. If you do not agree to any part of these Terms, the Privacy Policy, or the Refund Policy, you must immediately cease all use of the Website and/or Services provided by us.


3. MODIFICATIONS TO TERMS & CONDITIONS AND YOUR CONTINUED ACCEPTANCE
   1. Sampark Foundation reserves the exclusive right to change, modify, add or remove portions of these Terms and Conditions at any time. All modifications will be effective immediately upon posting the revised Terms on this Site. We will notify all users of any material changes to these Terms, which may include sending a pop-up notification upon your next visit to the Site, and/or posting a prominent notice on our Website homepage.
   2. Your continued use of the Site or Services following the posting of modifications and/or receipt of a notification constitutes your acceptance of those changes. You are solely responsible for reviewing these Terms periodically for any updates.
   3. Your non-termination or continued use of the Services or the Site after the effective date of any modifications reaffirms your acceptance of the Terms as modified.
   We will also update the “Last Updated” date at the top of these Terms. Your continued access or use of the Website after the date of the updated Terms constitutes your acceptance of the new Terms. If you do not agree to the new Terms, you must stop accessing and/or using the Website and Services immediately.


4. ACCEPTABLE USE
   All use of the Website must comply with these Terms and all applicable laws and regulations.
    
   1. You agree to use the Website and Services only for lawful purposes and in a manner that does not infringe upon or violate any intellectual property rights, proprietary rights, privacy rights, or other rights of any third party.
   2. You shall not use the Website to engage in any activity that is unlawful, fraudulent, threatening, abusive, harassing, defamatory, obscene, vulgar, harmful, invasive of another’s privacy, misleading, patently offensive, pornographic, promotes racism, bigotry, hatred, physical harm, or otherwise objectionable.    4. You further agree not to use the Website to send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or duplicative communications.
   5. You shall not use the Website to harvest, collect, or assemble information or data regarding other users without their consent or attempt to interfere with, disrupt, or impose an undue burden on the Website’s servers, networks, or infrastructure.
   6. You shall not attempt to gain unauthorized access to any part of the Website, including by using automated means, password mining, or any other method.
   7. You shall not frame, deep-link, or otherwise use any part of the Website in a manner that creates the appearance that your content is part of or endorsed by Sampark Foundation without prior written consent.
   Any violation of this Acceptable Use Policy will result in immediate suspension or termination of your access to the Website and may result in civil or criminal liability as permitted by applicable law.


5. INTELLECTUAL PROPERTY
   1. All intellectual property rights, including but not limited to copyrights, trademarks, patents, trade secrets, design rights, and any other proprietary rights in the Website, its content, products, services, and materials, are owned by Sampark Foundation in perpetuity and throughout the world. These Terms do not grant you any rights, title, or interest in or to any intellectual property of Sampark Foundation, except for the limited right to access and use the Website and Services for personal, non-commercial purposes in accordance with these Terms.
   2. Sampark Foundation either owns or holds valid, exclusive, worldwide, perpetual, irrevocable rights in perpetuity and throughout the world to exercise all intellectual property rights in the Website, platform, services, and content published thereon, including the user interface, layout, design, and informational content about our products and services such as Teach-Easy Kits, Smartshala App, Sampark TV, Sampark Dashboard, Sampark Didi Ke Sawaal, and AI-Driven Speak English Program.
   3. The Website also showcases pictures and messages of our founders, patrons, and partners, as well as videos demonstrating the use of our services and products, in which Sampark Foundation holds all intellectual property rights. Additionally, we publish regular blogs, annual reports, and media reports, which are solely our intellectual property. The Sampark Foundation name, logo, and trademarks (including any registered marks) are owned by us and protected under applicable intellectual property laws.
   4. Commercial use, redistribution or publication of all or any item displayed on the Site without express written authorization from Sampark Foundation is strictly prohibited. Some materials on the Website are owned by third parties and are used with permission; all rights for these materials are reserved by their respective owners, and any requests to use such materials must be directed to the indicated copyright owners. Nothing contained in these Terms and Conditions shall be construed as conferring any license or right to use any intellectual property without the express written permission of Sampark Foundation or the respective third-party owner.
   5. Materials on the Website may be used for personal, non-commercial use only provided that all copyright notices, authorship attributions and source indications are fully preserved and reproduced, no modifications of any manner are made to the content and each material/information is copied in its entirety. Certain materials outsourced to us have been published on the Website with all necessary permissions from the relevant copyright owners. All rights to these third-party materials are expressly reserved by their individual creators or owners and any request or permission to reproduce or use such materials must be directed to and authorized by the respective copyright owners.
   6. You must not modify, reproduce, distribute, republish, display, post, transmit, or commercially exploit any part of the content, trademarks, logos, graphics, videos, audio, or services provided on the Website without prior written permission from Sampark Foundation or our licensors.
   7. Any use of the Website or its materials that infringes upon Sampark Foundation’s intellectual property rights or violates applicable law is strictly prohibited. Unauthorized use, reproduction, distribution, or creation of derivative works from the Website’s content, services, or products will result in the immediate termination of your right to use the Website and may result in civil or criminal liability to the fullest extent permitted by law.
   8. Sampark Foundation reserves the right to remove any such communication or material from the Website at its own discretion.
   Your use of the Website constitutes your acknowledgment and agreement that all content, materials, services, trademarks, logos, and intellectual property rights displayed or used on the Website remain the exclusive property of Sampark Foundation or its partners and licensors.


6. USER CONTENT
   1. You are exclusively responsible for all information, data, text, and messages that you submit to us, including but not limited to the details provided when making a donation (such as your name, email, phone number, PAN/TIN number, address, and donation amount), using the “Contact Us” form, or providing any other feedback (“User Content”).
   2. You bear all risks associated with the use of your User Content.
   3. You hereby certify that your User Content is accurate and does not violate any applicable laws, and is not objectionable, defamatory, or infringing on any third-party rights. You may not represent or imply to others that your User Content is in any way provided, sponsored, or endorsed by Sampark Foundation. As you alone are responsible for your User Content, you may expose yourself to liability.
   4. Sampark Foundation is not obliged to backup any User Content you provide, and it may be deleted at any time without prior notice to you. You are solely responsible for creating backup copies of your User Content if you desire.
   5. Notwithstanding the foregoing, the collection, usage, and storage of sensitive personal information provided for donation purposes (including but not limited to PAN/TIN details and financial information) shall be strictly limited to the purposes explicitly defined in our Privacy Policy, such as donation processing, issuance of 80G certificates, and regulatory compliance, and will not be used for any other purpose beyond what is stated therein.
   6. For all other User Content, you hereby grant to Sampark Foundation an irreversible, nonexclusive, royalty-free, worldwide license to use and store your User Content solely for the purposes of processing your donation, responding to your inquiries, improving our services, and for other legitimate operational purposes as detailed in our Privacy Policy.
   7. You hereby irreversibly waive any claims and assertions of moral rights or attribution concerning your User Content.


7. ELIGIBILITY TO SPONSOR
   By accessing this website and utilizing our services, including the “Sponsor a Smart Class” feature to make a donation, you acknowledge and agree to the following eligibility requirements and information obligations.
    
   1. You affirm that you are at least 18 years of age and are legally competent to enter into a binding contract.
   2. You warrant that all information you provide during the donation process, including personal details and payment information, is accurate, current, and complete, and that you possess the lawful right to use any payment instrument employed.
   3. You understand that this information is necessary for processing your donation, issuing a valid 80G receipt, and for our legitimate operational purposes as laid down in the Privacy Policy as well. In the event you are a minor, you may donate only with the direct involvement and verifiable consent of a parent or legal guardian, who must execute the transaction on your behalf. Any donation received from an ineligible or misrepresenting user is subject to refusal or cancellation at our sole discretion.


8. TERMS FOR SPONSORING USING “SPONSOR SMART CLASS”
   By utilizing the “Sponsor Smart Class” feature to make a donation, you expressly acknowledge, agree, and consent to the following terms governing the processing of your contribution and information.
    
   1. All donations are processed exclusively through secure, third-party payment gateways authorized by the Reserve Bank of India, and you represent and warrant that you are authorized to use the selected payment method and that all provided payment information is true and accurate.
   2. The finality of your transaction is subject to approval from your financial institution and the payment gateway, and Sampark Foundation shall not be held responsible for any delays or declines originating from these third parties.
   3. You further understand and agree to abide by the terms and conditions of such third-party payment gateways and acknowledge that Sampark Foundation is not liable in case of any fraud or breach of data at the end of such third party payment gateway.
   4. You understand that the personal information collected during this process including but not limited to your name, contact details, PAN/TIN number, and payment details is necessary for the lawful processing of your donation, the issuance of a valid 80G tax exemption certificate under the Income Tax Act, 1961, and for our compliance with other applicable statutes including the Foreign Contribution (Regulation) Act, 2010 for foreign donations.
   5. You consent to the secure processing of your financial information by authorized RBI-compliant third-party payment processors, acknowledging that Sampark Foundation does not store sensitive payment data and that the storage and retention of your personal information may involve trusted service providers like AWS under strict confidentiality arrangements.
   6. You further acknowledge that, in certain limited circumstances such as a legal requirement, government inquiry, or corporate restructuring, your information may be disclosed to third parties solely to the extent necessary and in compliance with applicable data protection laws.
   7. You understand that while Sampark Foundation employs stringent technical and organizational security measures, including SSL/TLS encryption and role-based access controls, to protect your data, the foundation cannot be held liable for any breach on the part of its authorized third-party service providers over whom it exercises no direct control.
   8. We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of credit/debit cards or any other payment instrument. The financial information you provide, such as credit/debit card details, is collected and processed by authorized third-party payment gateways strictly for donation processing in compliance with RBI guidelines.
   9. Sampark Foundation does not store sensitive payment data, and we exercise no direct control over the processing activities of these third-party service providers. Consequently, we cannot be held liable for any breach on the part of such third parties, and your use of these payment services is undertaken solely at your own risk.


9. DISCLAIMERS
   1. The Sampark Foundation platform and the information contained herein are provided on an “as is” and “as available” basis. While we strive to keep the information accurate and up-to-date, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the Platform or the information, products, services, or related graphics contained on the Platform for any purpose. The Platform may be under constant upgrades, and some functions and features may not be fully operational. Any reliance you place on such information is therefore strictly at your own risk.
   2. To the fullest extent permissible by law, Sampark Foundation disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.
   3. The Site may contain links to external websites and resources that are owned and operated by third parties. We provide these links for your convenience only and exercise no control over their content, privacy practices, or security measures. We do not endorse, approve, or assume any responsibility for any Third-Party Platform. Your access and use of any such platforms is solely at your own risk.
   4. To the fullest extent permitted by law, Sampark Foundation shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, data, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform, any conduct or content of any third party on the Platform, any unauthorized access to or use of our servers and/or any personal information stored therein, or any errors or omissions in any content.


10. INTELLECTUAL PROPERTY RIGHTS NOTICE & TAKEDOWN PROCEDURE
    1. Sampark Foundation respects the intellectual property rights of others. The content on our Platform, including reports, blogs, and imagery, is published in good faith. If you believe that any content on our Platform infringes upon your copyright or other intellectual property rights, you may notify us in writing at contact@samparkfoundation.org.
    2. Your notice must include: (a) a physical or electronic signature of a person authorized to act on behalf of the rights owner; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material; (d) your contact information; and (e) a statement that you have a good faith belief that use of the material is not authorized by the rights owner.
    3. Upon receipt of a valid and complete notice, we will assess the claim and may, at our sole discretion, remove or disable access to the allegedly infringing content. This process is without prejudice to any other rights or remedies we may have and does not constitute an admission of liability. Sampark Foundation shall not be held liable for any such alleged infringement prior to the takedown of the content.


11. If there is any conflict between these Terms and Conditions and rules and/or specific terms of use appearing on the Website relating to specific material then the latter shall prevail.


12. These Terms and Conditions shall be governed and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the Courts at New Delhi.
